Irish climate case highlighted at UN Climate Talks

Ireland is one of six legal cases brought against Governments worldwide seeking stronger action against national greenhouse gas emissions which are being highlighted today at the UN Climate talks in Katowice, Poland.

Clodagh Daly, speaking on behalf of Climate Case Ireland, joined speakers representing legal challenges against the European Union, Germany, the Netherlands, Canada, and the US Federal Government.

The legal actions all aim to ensure that governments deliver the urgent cuts in emissions necessary to avert catastrophic climate change.

Ms Daly said the Irish Government ‘has a duty to protect us from harm by complying with its legal obligations, including human rights law and constitutional law.’

Pointing out that ‘the Irish government repeatedly endorsed the IPCC’s conclusion that developed countries’ emissions would need to decrease 25-40% between 1990 and 2020’, she told the audience at a Press Conference that ‘instead, the Irish Environmental Protection Agency predicts Ireland’s emissions will actually increase by 11-12% over this period.’

‘If we are to breathe life into the Paris agreement, we need to see bold, transformative policies across all sectors of the economy. Whilst our case itself cannot mandate what those changes should look like, owing to the separation of powers, the case seeks to have the 2017 National Mitigation plan quashed and remitted to the government for remaking in accordance with the law.’

‘The oceans are rising, and so are we’, Ms Daly concluded.

The case, taken by the Irish eNGO Friends of the Irish Environment, is due to be heard in the Irish High Court on January 22nd, 2019.
