Anti bin tax campaigners are now going to the High Court to fight the city council's right to impose waste charges. Although they lost their case in the District Court today, the appeal means the city council will have to wait until at least next year before they can summons residents for non payment of charges.
The Barrister hired by the "Campaign Against the Bin Tax" argued that the charge is invalid under law because it did not adhere to the principal of 'polluter pays'. He argued this on the basis that there is no reduction for those who recycle or those who buy products with less packaging. The Judge hearing the case ruled against him saying this was amplifying the principal to an unreasonable degree but he did however, consent to state a case to the High Court. The cases against three Finglas residents have now been adjourned until October 4th pending the outcome of the High Court case
