Leak of Patriot Act II
The Center for Public Integrity reports on details of leaked legislation in preparation which will continue the erosion of the traditional system of checks and balances that is supposed to be built into the American governmental system. Specifically the separation and balancing of the powers of the Executive and the Judiciary are supposed to make sure that the neither can do too much damage. This new, proposed legislation furthers the weakening of the Judiciary surrendering some of their powers to the Executive.
Highlights include:
1. DNA database of "suspected" terrorists
2. A removal of consent decrees against Police Departments [1]
3. Provisions to strip citizenship from suspected terrorists.
[1] Except for those relating to civil-rights cases. Consent decrees were obtained against many police departments that had been spying on US citizens for years, engaging in espionage and sabotage against them and racketeering.

Jump To Comment: 1Over several decades the U.S. Presidency has gradually appropriated to itself, in the field of foreign policy, almost dictatorial power. Whem it comes to areas of foreign policy there is no real judicial review of executive action. The judiciary goes through the motions but ultimately defers to the wishes of the execuvive. This was made clear when President Clinton deported Irish freedom fighter, Joe Docherty, despite a U.S. judge saying that the Docherty case was a classic, textbook example, of the case for political asylum. Here the judiciary was overruled arbitrarily by Clinon to satisfy Britain, his imperial junior partner.
