this ruling is very important - but it changes nothing for the people inside GITMO - they will not be released anytime soon - if at all, because of this rulling. (and it changes nothing for the children locked inside GITMO - nor does it release the ones the Pentagon says are innocent inside GITMO)
The most significant aspect of the ruling, IMO, is that the Sup Court said the Geneva Conv's ARE INDEED LAW - all so stupid really. Every school kid in America is taught that Treaties are law becaus ethe US Constitution says so, as they are passed by the Senate.
But in these darks times, Bush re-interpreted things so this was in question. - Well, it is not in question any longer.
Put aside GITMO for a sec, what does this mean for treaties the US has with EU states? or regarding the environment?
This could mean a lot in the future. On the other hand, Bush could just simply declare the Sup Court Null and Void - its not like many are challenging him in any serious way, so he could probably get away with it.
Sean, If you truly believe the house of cards is beginning to fall because of this ruling, then as the "New Yawhkers" say "I've got a Bridge in Brooklyn to sell you"- the ruling did not free one single detainee, did not say they couldnt continue to be held, did not comment on their conditions or the legality of holding them. Only that without a mandate from Congress that the tribunals were not supportable. Congress & the executive branch will fix that rather quickly. Nice attempt to spin though.
Laughable is the comment that Bush could declare the court null & void, if you seriously think bush has that much power unopposed & could declare himself "president for life", like so many south american & african dictators you will be sadly mistaken.
The armed forces would not take orders from such a person, the american public, which is better armed than most third world countries would ensure that could never happen. Facts dear child, not hysteria.

Bush and his puppet masters have been promoting a faux-Legal Theory called the 'Unitary executive theory' that essentially self-allows Bush to do whatever he thinks is necessary because, well...., because he was elected President and 'this is a different kind of war' and as we all know 'all the rules changed after 9/11'
